The Call Nobody Prepares For

A woman in her sixties loses her husband unexpectedly. He had a will — she was sure of that. He had the house in his name, a brokerage account, and a small rental property he'd owned for decades. She assumed the will meant everything would simply transfer to her.

It didn't.

Because those assets were titled in his name alone, they had to go through probate — a court-supervised legal process that took 14 months, cost nearly $22,000 in attorney fees and court costs, and required her to appear before a judge three times. She couldn't sell the rental property during that period. She couldn't access the brokerage funds. She was left managing two properties and household finances on a fixed income while waiting for the court to tell her what she already knew: her husband wanted her to have everything.

This story is not unusual. It plays out in courthouses across the country every day. And the tragedy is that with the right planning — much of it straightforward and affordable — most families can avoid it entirely.

What Probate Actually Is

Probate is the legal process through which a deceased person's estate is administered under court supervision. The word comes from the Latin probare — to prove. The court's original role was to verify that a will was authentic. Today, the process encompasses validating the will, inventorying assets, notifying and paying creditors, resolving disputes, and ultimately distributing what remains to the rightful heirs.

If the deceased left a valid will, the court appoints the named executor to carry out its instructions. If there is no will — a situation called dying intestate — the court appoints an administrator and applies the state's intestacy laws to determine who receives what. Those laws follow a formulaic priority order: spouse, then children, then parents, then siblings, and so on. They do not know your actual wishes, your family dynamics, or your reasons for treating different heirs differently.

Either way, probate is a public proceeding. The will is filed with the court and becomes a public record. Anyone — a creditor, a distant relative, a curious neighbor — can read it.

What Has to Go Through Probate

Here is the critical distinction that surprises most families: not all assets go through probate. What determines whether an asset is subject to probate is not whether there is a will. It is how the asset is titled and whether it has a named beneficiary.

Assets that typically must go through probate include:

Real estate titled solely in the deceased's name
Bank accounts without a payable-on-death (POD) designation
Investment accounts without a transfer-on-death (TOD) designation
Personal property — vehicles, jewelry, artwork, furniture — titled in the deceased's name
Business interests that aren't structured with succession in mind

Assets that typically pass outside of probate include:

Retirement accounts (IRAs, 401(k)s) with named beneficiaries
Life insurance policies with named beneficiaries
Bank and brokerage accounts with POD or TOD designations
Property held in joint tenancy with right of survivorship
Assets held in a properly funded revocable living trust

This is why so many families are surprised to find themselves in probate even when the deceased had a will. The will only controls the probate assets. Everything with a beneficiary designation or a survivorship title passes automatically — and those designations override whatever the will says.

The Probate Process, Step by Step

The specific procedures vary by state, but the basic probate process follows a predictable sequence.

Filing the Petition. After a death, the executor named in the will — or a family member if there is no will — files a petition with the probate court in the county where the deceased lived. The court issues Letters Testamentary (or Letters of Administration for intestate estates), which formally authorize the executor to act on behalf of the estate.

Notifying Creditors. State law requires that creditors be formally notified of the death, typically through a published notice in a local newspaper and direct notice to known creditors. Creditors then have a set period — usually 90 days to six months, depending on the state — to file claims against the estate.

Inventorying the Estate. The executor must locate and inventory all probate assets, obtain appraisals where required, and file an inventory with the court. This step can be particularly burdensome when the deceased had complex or disorganized finances.

Paying Debts and Taxes. Valid creditor claims must be paid from estate assets before any distribution to heirs. Final income taxes are filed. If the estate is large enough to trigger federal or state estate taxes, those are calculated and paid as well.

Distributing the Remaining Estate. Only after debts, taxes, and administrative expenses are settled can the remaining assets be distributed to the beneficiaries named in the will (or determined by intestacy law). The executor files a final accounting with the court and petitions for the estate to be closed.

What Probate Costs — and How Long It Takes

The two factors that most shock families going through probate are the cost and the timeline.

Cost. Probate expenses typically include court filing fees, executor compensation (often a statutory percentage of estate value), attorney fees, appraisal fees, and publication costs. In states with expensive statutory fee schedules — California, Florida, and New York, for example — probate fees can consume 3 to 7 percent of the gross estate value. On an estate worth $700,000, that is $21,000 to $49,000 in fees before the first dollar reaches an heir. And that is for an uncomplicated estate. Contested probates — where heirs dispute the will, creditors fight claims, or an executor's conduct is challenged — can cost dramatically more.

Timeline. A simple probate in a well-organized state might close in six months. Most take 12 to 18 months. Complex estates, contested proceedings, or court backlogs can stretch the process to two years or more. During that time, the estate is largely frozen — the executor can manage assets but may not freely distribute them to heirs.

For heirs who were financially dependent on the deceased — a surviving spouse who needs access to liquid assets, a family business that needs decisions made — this delay is not merely an inconvenience. It can be a genuine crisis.

Strategies to Avoid Probate

Probate is not inevitable. With proper planning, most families can structure their estates so that assets pass quickly, privately, and without court involvement. Here are the most effective approaches.

1. Revocable Living Trust

A revocable living trust is the most comprehensive probate-avoidance tool available. You create the trust, transfer your assets into it during your lifetime, and name yourself as trustee so you retain full control. When you die, a successor trustee you have named distributes the assets to your beneficiaries according to your instructions — no court required, no public record, no waiting period.

A properly funded trust bypasses probate entirely for everything it holds. The key word is "funded." A trust that exists on paper but holds no assets does nothing. Every significant asset — the house, the brokerage account, the vacation property — must be formally retitled into the trust's name. This step is where many families fall short, leaving behind a trust that looked complete but failed its purpose at the critical moment.

2. Beneficiary Designations

For retirement accounts and life insurance, updating beneficiary designations is the single most powerful and most overlooked planning tool available. These designations operate entirely outside of your will and your trust. They pass assets directly to the named individual at death, with no court involvement whatsoever.

The catch: designations that are outdated, missing, or incorrectly drafted cause enormous problems. A retirement account with no named beneficiary becomes a probate asset. A designation that names a deceased spouse — never updated after a divorce or a death — can divert assets to unintended recipients. Reviewing beneficiary designations every few years, and after every major life event, is essential maintenance for any estate plan.

3. Joint Tenancy with Right of Survivorship

When two people own property as joint tenants with right of survivorship, the surviving owner automatically inherits the deceased owner's share — without probate. This is one of the most common ways married couples hold their homes, and it works smoothly in straightforward situations.

The limitations matter, however. When both joint tenants die — or when the survivor later dies — the property will still pass through probate unless other arrangements are in place. Joint tenancy also carries gift tax and capital gains implications that a trust generally handles more cleanly. It is a useful tool but rarely a complete solution on its own.

4. Transfer-on-Death and Payable-on-Death Designations

Many states allow real estate to be titled with a transfer-on-death (TOD) deed, sometimes called a beneficiary deed. Like a POD designation on a bank account, a TOD deed names the person who receives the property at the owner's death — automatically, without probate.

TOD and POD designations are simple, inexpensive, and highly effective for specific assets. They are not substitutes for a comprehensive estate plan, but they are excellent supplements. Adding a POD designation to a bank account takes minutes and can save your heirs months of waiting.

5. Lady Bird Deeds (Enhanced Life Estate Deeds)

A Lady Bird deed — also called an enhanced life estate deed — is available in a handful of states including Florida, Michigan, Texas, Vermont, and West Virginia. It allows the owner to transfer real estate to a named beneficiary at death while retaining full control of the property during their lifetime, including the right to sell or mortgage it without the beneficiary's consent.

The Lady Bird deed avoids probate and, in states that recognize it, does not trigger Medicaid estate recovery for the transferred property. For families in eligible states who want a simple, low-cost way to pass a home outside of probate without establishing a full trust, it is an excellent option.

When Probate May Not Be Worth Avoiding

Probate is not always the enemy. There are situations where going through the process makes sense — or where the cost of avoiding it exceeds the cost of the process itself.

Small estates often qualify for simplified or expedited procedures. Most states have small estate affidavits or summary administration processes for estates below a certain threshold — often $50,000 to $100,000, though limits vary widely by state. These streamlined processes are far less expensive and time-consuming than formal probate.

Probate also provides a structured creditor claims process. If you are concerned about outstanding debts, the formal claims period provides a clear cutoff date after which creditors cannot pursue estate assets. A trust does not provide this same protection automatically.

And if an estate is likely to be contested — if you expect a family member to challenge your will or the validity of trust documents — having the matter go through court supervision can sometimes create a cleaner resolution than a private trust proceeding.

The Documents You Still Need Even With a Trust

Avoiding probate does not mean you can skip the rest of your estate plan. A revocable living trust should always be accompanied by a pour-over will — a simple will that catches any assets not properly transferred into the trust and directs them into the trust at death. This backup ensures that overlooked assets end up in the right place, even if they briefly pass through probate.

You also still need a durable financial power of attorney, a healthcare power of attorney, and an advance directive. These documents protect you while you are alive and incapacitated — they have nothing to do with probate, but they are equally non-negotiable. Without them, a court-supervised guardianship or conservatorship proceeding may be required just to manage your affairs during a medical crisis.

The Bottom Line

Probate is not a punishment. It is a default — the system that kicks in when no other arrangement has been made. For many families, it is an expensive, time-consuming default that could have been avoided with planning that takes far less effort than the process itself.

The families who avoid probate are not wealthier or more sophisticated. They are simply the ones who took the time to structure their estates intentionally: funding a trust, updating beneficiary designations, retitling property, and reviewing their plan after major life events.
